RACE 9 (R1409) CLASS 5 1400M (LONG COURSE A)
Upon jumping, SKY WALKER (App KC Tham) jumped inwards and bumped
ESPERANZA (Lou Ho).
WAWA MASTER (F Yap) jumped awkwardly, got its head up shortly after the start and
Approaching the 1200M, DONTCALLME UNCLE (J Low) had to be eased off the heels
of TEEN ANGEL (App CK Khaw) which shifted in abruptly. App CK Khaw will be
shown the official patrol film of this incident during apprentice school and will be warned
to ensure that he allows sufficient room to the other runners than he did on this occasion.
GOLD STAR PRINCESS (SS Vanan) and CLAIM (Y Aify) were caught racing wide
throughout the event.
ESPERANZA (Lou Ho) was momentarily held up for a clear run entering the home
straight on the run to the finish before gaining a clear run at the 350M.
The Stewards questioned Jockey Y Aify into the tactics that were adopted on CLAIM.
Jockey Y Aify explained that from a wide Barrier 15, he attempted to gain a trailing
midfield position as per the Trainers Instruction Form, however, was caught wide from
the barrier and was unable to get a position closer to the rails. He further stated that he
placed the gelding under pressure in the home straight but it only responded fairly. Jockey
Y Aify further stated that the gelding may not have backed up from its last week previous
race start over the 1600M and this may have contributed to its performance today. The
Stewards, after reviewing the official patrol film and acting on their own observations, did
not take any action against Jockey Y Aify and noted his comments for future reference.
The Stewards questioned Jockey HS Gill into the performance of KIM SALUTE. Jockey
HS Gill stated that from a wide barrier, he attempted to gain a forward position to take up a
handy position as per his Trainers Instruction, however, due to the pace in the event,
found himself 3-deep throughout the event. He also stated that he attempted to improve his
position from the 800M and in the home straight, placed it under pressure but it failed to
respond to his riding and that the gelding raced like a tired horse. A post-race veterinary
examination of KIM SALUTE revealed no significant finding.
The Stewards questioned App KC Tham and Trainer Jerome Tan who was also deputizing
for Trainer BT Lim, the Master of App KC Tham, into the tactics that were adopted on
SKY WALKER in particular over the final 600M.
At the conclusion of an Inquiry, after taking evidence from App KC Tham, the rider of
SKY WALKER, in the presence of his Acting Master, Trainer Jerome Tan and after
reviewing the official patrol films and considering the evidence tendered, the Stewards
acting on their own observations, App KC Tham was found guilty of a charge under MRA
Rule 44(8) in that whilst riding SKY WALKER from the 600M until the winning post in
this race, he failed to take all reasonable and permissible measures to ensure that SKY
WALKER was given full opportunity of winning or of obtaining the best possible placing.
In assessing the penalty, the Stewards took into consideration App KC Thams mitigating
factors, previous riding record and his submissions on penalty. After considering the
provisions of MRA Rule 44(8)(a), App KC Tham was disqualified for a period of one (1)
year with immediate effect from 6 November 2016 and to expire on 5 November 2017,
both dates inclusive. He was advised of his Right of Appeal (6:30pm). A post-race
veterinary examination of SKY WALKER revealed no significant finding.
IKTO which was beaten 22 1/4 lengths, will be required to pass a 1000M/vet test before
being declared to race again for having a poor performance.

App R Fakruddin and App S Zulfikri were both fined RM100/- under MRA Rule 50(4) for
failing to submit their Permission to Ride Forms to the Stewards.

The Stewards questioned Jockey C Goon into the tactics that were adopted on JUST
VITAL. The Stewards were concerned into the reasons why he shifted wider to race wide
from the 700M and continued to race wide for the remainder part of the event where in the
opinion of the Stewards, they believed he may have covered more ground than necessary.
Jockey C Goon stated that he was riding to instructions to be mid-to-back position and this
was confirmed by the Stewards from the Trainers Instruction Form. He believed shortly
after the start, he suffered some interference in front of him and as a result, found himself
further back than he had wanted, and approaching the 700M, he believed that it was better
for him to race wider on the track which gave him an opportunity to shift to the middle of
the track on entering the home straight.
He further explained that the previous days, most winners were coming down the middle
of the track and that was the intention on this occasion and he placed the gelding under
pressure at the 300M and the gelding ran home strongly.
The Stewards, after reviewing the official patrol film and reviewing the geldings previous
race starts, gave Jockey C Goon a benefit of the doubt on this occasion, however warned
him, in the strongest terms, that he would be expected to ride all his horses out in such a
manner so as to leave no room for query.

MY SWALLOW will be required to pass a 1000M/vet test before being declared to race

Acting on an advice from the Veterinary Department, the 2-week embargo imposed on
SUPER VICTORY is now rescinded.
