RACE 2 (R138) CLASS 5 1100M, [NEW LIBERTY HANDICAP],
SUNDAY, 25TH JANUARY 2015, 2ND DAY, PENANG TURF CLUB
JANUARY MEETING 2015

At the conclusion of an Inquiry on 8th February 2015, after taking evidence from Trainer
HS Lim and Jockey J Shankar, the trainer and rider of PROVIDENCE respectively, and
reviewing the films, Jockey J Shankar was found guilty of a charge under MRA Rule
44(7) in that whist riding PROVIDENCE in the above race, he prevented PROVIDENCE
from running on its merits.

The particulars of the charge were that at the start of the race, Jockey J Shankar gave
PROVIDENCE insufficient rein, restrained the gelding and thereby prevented
PROVIDENCE from starting on terms with the field and causing this gelding to lose
considerable ground at the start.

When deciding on penalty, the Stewards took into consideration the seriousness of the
offence, Jockey J Shankars riding record and the provisions of MRA Rule 44(8)(a).
Jockey J Shankar was disqualified for a period of one (1) year with immediate effect
from Sunday, 8th February 2015 and to expire on Sunday, 7th February 2016, both dates
inclusive. In addition, he was fined a sum of RM50,000/- (Malaysian Ringgit Fifty
Thousand) and was advised of his Right of Appeal (12.35 pm).

Jockey J Shankar subsequently exercised his Right of Appeal and applied for a stay of
sentence which was declined by the Stipendiary Stewards.

Jockey J Shankars subsequent appeal to the PNTC Racing Stewards against the decision
of the Stipendiary Stewards not to grant him a stay of sentence was also dismissed by the
Racing Stewards and his deposit was forfeited.

RACE 2 (R177), SUNDAY, 1 FEBRUARY 2015, SELANGOR TURF CLUB
FEBRUARY MEETING 2015

At the conclusion of an inquiry on 6 February 2015 at the Selangor Turf Club, Jockey
Lou Ho, the rider of TRUE HERITAGE, pleaded guilty to a charge of careless riding
under MRA Rule 44(9)(a)(ii) in that shortly after the start, he shifted in when
insufficiently clear of LITTLE LION (J Low) which was racing to the inside and had to
be severely checked by its rider.

In assessing the penalty, the Stewards took into account Jockey Lou Hos guilty plea,
mitigating factors and his previous riding record. He was suspended from riding in races
for a period of three (3) race days with immediate effect from 6 February 2015 and to
expire on 15 February 2015, both dates inclusive. He was advised of his Right of Appeal.

RACE 6 (R181), SUNDAY, 1 FEBRUARY 2015, SELANGOR TURF CLUB
FEBRUARY MEETING 2015

The Stewards, on 6 February 2015 at the Selangor Turf Club, concluded an inquiry into
the reasons LEE BANK shifted outwards at the 700M, and lost its position and valuable
ground.

After taking further evidence from Jockey I Fadzlei, the rider of LEE BANK and viewing
the official patrol films and the Stewards acting on their own observations, Jockey I
Fadzlei pleaded guilty a charge under MRA Rule 44(9)(b)(iii) for incompetent riding.
The particulars of the charge were that passing the 700M in this race, he allowed LEE
BANK to shift outwards by accidentally dropping his near side rein which made the
horse running outwards and as a consequence, he lost his position at that crucial point and
lost his chance of gaining the best possible placing in the event.

In assessing the penalty, the Stewards took into consideration Jockey I Fadzleis guilty
plea, mitigating factors, previous riding record and his submissions on penalty. Acting on
the provisions of MRA Rule 48(5), the Stewards deferred the commencement of Jockey I
Fadzleis suspension. He was suspended from riding in races for a period of 2 months
with effect from 15 February 2015 and to expire on 14 April 2015, both dates inclusive.
He was advised of his Right of Appeal.

Jockey I Fadzlei, the rider of LEE BANK, also pleaded guilty under MRA Rule 44(11) in
that he failed to report to the Stewards as soon as possible anything that may have
affected the chances and performance of his horse following the completion of the event.
In assessing the penalty, the Stewards took into consideration Jockey I Fadzleis guilty
plea, mitigating factors, previous riding record and his submissions on penalty. He was
fined RM3,000/- and advised of his Right of Appeal.

RACE 3 (R178), SUNDAY, 1 FEBRUARY 2015, SELANGOR TURF CLUB
FEBRUARY MEETING 2015

The Stewards, on 6 February 2015 at the Selangor Turf Club, questioned Jockey Lou Ho,
the rider of FOX CALL, into the riding tactics that were adopted on FOX CALL
throughout the event.

Jockey Lou Ho confirmed his instructions were to be midfield which were confirmed by
the Stewards from the Trainers Instruction Form. He stated that racing to the 1000M, the
gelding over-raced and had to be restrained for some distance off the runners in front and
after passing the 500M, was pushed wider by another runner resulting in him covering
extra ground. He further stated that he placed the gelding under pressure from the 300M
but it failed to respond to his riding.

The Stewards, after viewing the patrol films of this event and previous race starts,
informed Jockey Lou Ho in the strongest terms that all his future mounts must be fully
tested and ridden out fully in such a manner so as to leave no room for query.
