Jockey M Djulkifli explained that his instructions were to be midfield to back which were
confirmed from the Trainers Instruction Form. He further stated that from the 800M
until entering the straight, he had kept the gelding balanced and when racing to the 400M,
he commenced to ride with the whip in his left hand, however when struck on the arm by
Jockey J Saimee, the rider of ADMIRAL KHONG, he decided to change the whip to his
right hand. Jockey M Djulkifli added that SUBORDINATE finished the race off well.

The Stewards further questioned Jockey M Djulkifli as to whether he had genuinely
struck SUBORDINATE with the whip in the right hand and he said that he had made
contact with the whip but on viewing the film, admitted that he had not made contact on

2012, PENANG TURF CLUB YANG DI-PERTUA NEGERI GOLD CUP
MEETING 2012

The Stewards concluded an inquiry today (15th January 2013) into the above race.

As Jockey HS Gills witness is not available to attend todays inquiry, Jockey HS Gill,
the rider of ELEVENTH AVENUE had decided to change his plea from not guilty to
guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that near the
1100M, he allowed his mount ELEVENTH AVENUE to shift inwards whilst riding
along, when insufficiently clear of JACK OF HEARTS (V Sivan), thereby taking that
gelding in onto BLACK COFFEE (K Eirwan) causing that gelding to check and lose
ground.

When deciding on penalty, Stewards took into account his guilty plea and riding record.
Jockey HS Gills licence to ride in races was suspended for a period of three (3) race
days, effective today, Tuesday, 15th January 2013 and to expire on Friday, 25th January
2013, both days inclusive. He was advised of his right of appeal (3.16 pm).

MEETING 2012

The Stewards concluded an inquiry today (15th January 2013) into the ride of App KY
Yap on SUCH A GOOD TME in the above race.

Evidence was taken from App KY Yap, the rider of SUCH A GOOD TIME, and Trainer
MH Wee, master of App KY Yap and trainer of SUCH A GOOD TIME. Both Trainer
MH Wee and App KY Yap were assisted by Miss Mok Cheng Yoon, a certified High
Court Interpreter.

App KY Yap stated that he was instructed to get a good jump, sit where comfortable,
make his move near the 800M, and do his best in the straight. App KY Yap said that his
mount was slowly away and thereafter he had to urge SUCH A GOOD TIME along in
the early stages. He said that near the 800M, he had to steady for some strides off the
heels of FABERGE (TM Wan) and on the inside of CAPTAIN PENANG (J Shankar).
He said thereafter near the 600M, he was held up for a run behind FABERGE and on the
inside of CAPTAIN PENANG and approaching the 400M, he had to shift outwards
abruptly across the heels of SHIOK SHIOK (K Eirwan) which shifted inwards when
commencing to give ground. App KY Yap further stated that he rode his mount out to
the best of his ability to the line and in his opinion, SUCH A GOOD TIME made up
ground in the straight. His explanation was noted.

Trainer MH Wee confirmed the instructions and stated that SUCH A GOOD TIME has a
habit of missing the start and the gelding got further back than anticipated. Trainer Wee
said that he expected SUCH A GOOD TIME to have a small chance in the placings in
what he believed was a stronger field than its last start. His explanation was noted.

After viewing the films and considering all the evidence, the Stewards took no further
action.
